DCSF Letter to Headteachers - March 2009

Each member of your staff whose details will be collected as part of the School Workforce Census needs to be made aware of the Privacy Notice.  The submission of the School Workforce Census return, including a set of individual staff records is a statutory requirement on schools and LAs under the Education Act 2005.

By putting the School Workforce Census on a statutory basis schools do not need to obtain consent for the provision of information on individual members of the workforce (schools must, however, meet their obligations under the Data Protection Act).  It also means that Schools are protected from any legal challenge that they are breaching a duty of confidence to their staff members.
